Return Policy

All Merchandise purchased by Customer through Sarah Barnard Design LLC shall be considered a “custom” sale and as such is not returnable or eligible for cancellation or refund. Sarah Barnard Design LLC does not make any express or implied warranty and expressly disclaims all warranties on any Merchandise.

Customer must inspect all Merchandise purchased by Customer through Sarah Barnard Design LLC within twenty-four (24) hours of delivery of the Merchandise . Customer must notify Sarah Barnard Design LLC of any and all defects or damage to the Merchandise within this twenty-four (24) hour timeframe. In the event Merchandise is delivered damaged, and Customer notifies SBD LLC of the damage within twenty-four (24) hours of placement of the Merchandise on Customer’s premises, Customer is required to provide Sarah Barnard Design LLC or vendor of the Merchandise the opportunity to repair or replace the Merchandise with a suitable replacement item.

No Chargebacks. Customer agrees to waive their right to the retrieval process with their credit card company. Customer understands that the charges on a credit card are irrevocable, undisputable and may not be charged back, contested or challenged now or in the future, doing so is a material breach of this agreement.

Terms Of Service

Sarah Barnard Design LLC (SBD LLC) shall not be responsible for the malfeasance, negligence or failure of any contractors, manufacturers, showrooms and/or suppliers to perform their respective duties and responsibilities in a satisfactory manner and/or to meet their deadlines. You agree, by purchasing goods through us, that it is reasonable for us to rely on our manufacturer’s and supplier’s statements as to the condition of the goods, as well as representations regarding the goods. For example, if a supplier labels their product as “vegan”, you agree it is reasonable for us to rely on the supplier’s representation and that you have no claim against us if that representation later turns out to be false or misleading. We have no capability to independently verify statements from our suppliers and manufacturers. You agree you shall have no claim against us for representations or warranties made by us in reliance on our suppliers and/or manufacturers and that your sole remedy is limited to your purchase with us. In no event shall SBD LLC be liable for damages in excess of the sale price of your goods. We do not represent or warrant the biological/ecological/health effect(s) (whether global or local) of any products recommended, or products sold, and all products are sold “as-is” regarding the biological/ecological/health effect(s) of any product sold or recommended by us. SBD LLC hereby advises Customer that many of the products that SBD LLC purchases for inclusion in the Project may include warnings pursuant to Proposition 65. SBD LLC has no means of monitoring the manufacturers’ compliance with the requirements of Proposition 65.  Accordingly, Customer acknowledges and agrees that SBD LLC has no independent duty to determine whether any item or service has or should have Proposition 65 warnings. Any Merchandise not accepted for delivery by Customer will be placed into storage and all storage fees plus administrative costs related to coordinating storage will be billed to, and paid by Customer. Customer understands that SBD LLC cannot predict or control the methods in which heavy, delicate and valuable items may be moved by Customer’s contractors. Customer agrees that their general contractor, not SBD LLC, shall be responsible for and oversee any crane service, forklift service, elevator service, padding and protection, and or building modifications required to create access related to delivery of Merchandise.

Customer understands and agrees that SBD LLC is required to collect sales tax on any element of the charges billed by SBD LLC to Customer which is deemed a taxable sale under regulations issued by the California Department of Tax and Fee Administration or other similar regulatory authority in other states where Customer is located. Customer agrees to reimburse SBD LLC for any additional tax in the event of any audit by a taxing authority which determines that a sales tax was owed for any such element charged to Customer for which tax was not collected. Likewise, if such an audit determines that sales tax was not owed on an item sold to Customer, SBD LLC will reimburse the amount of sales tax collected.
